Nevada Temporarily Bans Kalshi Sports Event Contracts Until At Least April 3

Kalshi sports event, entertainment, and election contracts have been banned in Nevada until at least Friday, April 3.

The First Judicial District Court of the State of Nevada in and for Carson City on Friday, March 20, granted the Nevada Gaming Control Board’s request for a temporary restraining order against Kalshi, effectively banning the markets for the next two weeks.

Kalshi removed the prediction markets from Nevada on Saturday, March 21. Nevada is the first state in which Kalshi has removed its sports event contracts due to a court order.

Potential Return in April

The prediction market company will not be able to offer sports event contracts in the state for 14 days until a preliminary injunction hearing is held on Friday, April 3. Depending on the outcome of the injunction, Kalshi will either be able to return to the state with its sports, election, and entertainment contracts on that date, or will be prohibited from offering the contracts throughout the entirety of the lawsuit.

Kalshi offered no comment on the court decision to Sports Betting Dime.

Kalshi informed its Nevada customer of the change by email on Saturday, March 21. The following message was sent to all Nevada Kalshi account holders:

“Hi there. We’ll cut to the chase. Due to a temporary court order, our markets related to sports, entertainment, and elections are being restricted in Nevada. You can still sell your positions or wait for them to resolve, but you won’t be able to buy new contracts. All of our other markets – including crypto, weather, and world news – are still available. This situation is unprecedented – Nevada is currently the only state with temporary restrictions in effort due to a court order. We disagree with those restrictions, but as a law-abiding company, we’re following them. We’re confident in our legal position, and we’ll continue to fight for your right to trade the same products that are available in 49 other states. We built Kalshi to give everyone a fair and open access to markets. Citizens of Nevada should not be forced into a business model designed to penalize winner and maximize user losses. A temporary restraining order is not appealable under Nevada state law, so Kalshi has no choice but to temporarily ban the contracts.

The NGCB considers sports event contract, and certain other event contracts, to constitute illegal sports betting activity under state law. The board filed an application for an immediate temporary restraining order and motion for preliminary injunction against Kalshi last month, which would likely require the company to geofence Nevada and prohibit the trading of sports event contracts.

The Nevada Gaming Control Board filed a lawsuit against Kalshi in February.

“Kalshi has repeatedly stated that its operations are legal in 50 states, which is clearly not true,” Chairman of the Nevada Gaming Control Board Mike Dreitzer said in a press release. “Prediction markets, to the extent they facilitate unlicensed gambling, are illegal in Nevada, and we have a statutory duty to protect the public. We want people in the state to wager safely at a licensed book.”

A Year Long Fight in Nevada

Legal action between the company and Nevada has been ongoing now for nearly a year.

KalshiEX LLC filed its lawsuit against the NGCB for a cease-and-desist notice sent to the company regarding their sports event prediction markets on March 30, 2025.

The Nevada Gaming Control Board levied a cease-and-desist notice against Kalshi in early March, ordering the company to stop offering its sports event contract markets in the state by March 14, 2025. Kalshi did not acquiesce to the notice.

Kalshi argues that Congress previously gave the Commodity Futures Trading Commission (CFTC) exclusive jurisdiction to regulate futures trading on approved exchanges. As the CFTC has allowed Kalshi to launch its sports event contract markets, state law cannot “intrude on the comprehensive federal scheme for regulating designated exchanges.”
