These states have not issued formal cease-and-desist letters or court injunctions against prediction market operation as of early 2026 — meaning traders generally face less legal risk when accessing Kalshi or Novig for Super Bowl markets.

Not all states are welcoming prediction markets. Some have taken action against Kalshi specifically, often interpreting sports contract markets as “unlicensed gambling.” These include:

  • Nevada: State gaming regulators have challenged Kalshi’s sports contracts.
  • Maryland: Federal court rulings sided with state regulators against Kalshi sports markets.
  • Connecticut & Arizona: Cease-and-desist orders issued.
  • Ohio: State has issued cease-and-desist and legal challenges.
  • Massachusetts: Judges have ruled Kalshi must stop sports event contracts.
  • Illinois, New Jersey, Montana and others: Documented legal challenges or enforcement actions.

In these states, access may be restricted or subject to blocking, and users could face legal ambiguity or platform geofencing.
