DraftKings Files Additional Fantasy Sports Trademarks For “DraftKings Pick 6”

  • DraftKings filed for a new fantasy sports trademark earlier this month
  • The trademark filing is for three variations of the term “DraftKings Pick 6”
  • It’s the second round of fantasy sports trademark filings the company has made since May

DraftKings is suddenly busy in the fantasy sports trademark game, as the company last week filed for another new trademark.

DraftKings submitted trademark applications for “DraftKings Pick 6,” “DraftKings Pick6,” and “DraftKings Pick Six” with the United States Patent and Trademark Office on Friday, Oct. 6. All three trademark applications are intended for “entertainment services in the nature of fantasy sports competitions.”

It’s the second round of trademark applications made since the company filed a fantasy sports trademark for “DraftKings Cashpicks” on May 11, 2023.

What is DraftKings Pick 6?

Like DraftKings Cashpicks, not much is known about “DraftKings Pick 6” other than what’s included in the company’s trademark filings. All three are “intent-to-use” trademarks, which means DraftKings has yet to use the term in commerce, but intends to do so sometime in the next several years.

According to the three applications, the trademarks will be used for a type of online fantasy sports mobile application.

“Downloadable mobile applications for use in fantasy sports competitions, namely, mobile applications for managing and participating in fantasy sports competitions,” the company wrote in their applications.

The applications also note that the trademarks will be used for “entertainment services in the nature of fantasy sports competitions.”

“Entertainment services in the nature of fantasy sports competitions, provided via downloadable mobile software applications, via a website, and distributed via various platforms across multiple forms of transmission media. Entertainment services in the nature of sports betting,” the company wrote.

X-user @MikeDzikowski was the first to find the trademark applications on the United States Patent and Trademark Office website.

DraftKings could not be reached for a comment on these latest trademark applications.

Last Round of Filings Brought Attention

When DraftKings registered for “DraftKings Cash Picks” back in May, and it was brought into the light in September, it caught the attention of at least one daily fantasy sports competitor.

Jeremy Levine, founder and co-CEO of Underdog Fantasy, acknowledged the news of the “DraftKings Cash Picks” trademark application on his X social media account.

Levine could not be reached for a comment regarding “DraftKings Pick 6.”

Levine and Underdog Sports, as well as fellow DFS operator PrizePicks, have both recently been at odds with DraftKings and FanDuel. In August, Levine took to his social media feeds and implied that both FanDuel and DraftKings have used their influence to create difficulties for the DFS operators.

He also wrote an open letter to the “Underdog Community,” which can be found here.

“FanDuel and DraftKings are coordinating their lobbyists, market power, partners and years of political contributions to try to stop us and other fantasy companies. Why? We’re beating them in fantasy, and we’re not stopping there,” Levine wrote in a tweet.

Both Underdog Sports and PrizePicks have claimed their parlay-style, over-under type offerings fall under the Unlawful Internet Gambling Enforcement Act (UIGEA) carveout for games of skill.
